Critical Due Diligence: Contracts & Auckland LIM Timelines

Buying property is a significant commitment. We strongly advise that you consult Quay Law **before** signing any Sale and Purchase Agreement. Once signed, a contract is legally binding, and inserting protective clauses retrospectively is rarely possible.

Our due diligence review encompasses:

  • **Land Title Review**: Inspecting easements, land covenants, and interests registered against the record of title.
  • **Finance Conditions**: Aligning approval deadlines with your lender’s processing windows.
  • **Building Inspector Reports**: Ensuring clauses accommodate structural, moisture, and plumbing inspections.

Auckland Council LIM Notice

A Land Information Memorandum (LIM) is essential to identify unconsented works, public drainage paths, rates issues, and natural hazards. In Auckland, the standard processing window for a LIM is 10 working days.

Important Contract Tip: When making an offer subject to a LIM condition, you must ensure the condition date is set at least 12 to 15 working days out from the signing date to allow for Council delays and legal analysis.

The Quay Law Advantage in Property Transactions

How our boutique legal model protects your property interests and financial assets.

Direct Solicitor Responsibility

Your property transaction will not be passed down to administrative clerks or automated processing templates. Principal solicitor Ian Mellett personally oversees your file, reviews the titles, and executes your electronic LINZ registration.

Property Tax & Asset Protection

Ian's Higher Diploma in Tax Law (H Dip Tax) allows Quay Law to review your bright-line property tax exposure, advise on tax obligations for rental investors, and structure property ownership correctly through trusts or companies.

Overseas Buyers & OIA Compliance

If you are a new migrant or resident returning from overseas, we navigate the complex Overseas Investment Act (OIA) regulations to determine your eligibility to purchase residential land in New Zealand.

Request a Transparent Legal Fee Estimate

Property Conveyancing FAQs

We download and audit the Record of Title directly from Land Information New Zealand (LINZ). We check if the title is Freehold, Leasehold, Cross-lease, or Unit Title, and inspect any registered interests: mortgages, easements (such as shared driveways or council pipelines), covenants (which restrict land usage, colors, or materials), and caveator warnings.

On settlement day, we coordinate the transfer of funds. If you are the buyer, we receive your KiwiSaver/deposit and mortgage funds into our Trust Account, and transfer the balance to the seller's lawyer. Once the seller's lawyer confirms receipt, they release the keys, and we register you as the new owner electronically via the LINZ e-dealing platform. This typically finishes by 4:00 PM.

A cross-lease title means you own a share of the freehold land under a tenancy-in-common, and lease your specific dwelling from all the co-owners collectively. It is highly regulated. Risks include unconsented structural additions (which violate the flat plan, making the title defective) or disputes over shared spaces. We perform plan audits to make sure the flat plan matches the physical building shape.

If you are utilizing KiwiSaver for your deposit or settlement, you must submit withdrawal applications to your provider at least **15 working days** before the settlement date. Your provider will release the funds directly into our Trust Account. We hold the funds in trust until they are required for settlement.
