Property Conveyancing FAQs
We download and audit the Record of Title directly from Land Information New Zealand (LINZ). We check if the title is Freehold, Leasehold, Cross-lease, or Unit Title, and inspect any registered interests: mortgages, easements (such as shared driveways or council pipelines), covenants (which restrict land usage, colors, or materials), and caveator warnings.
On settlement day, we coordinate the transfer of funds. If you are the buyer, we receive your KiwiSaver/deposit and mortgage funds into our Trust Account, and transfer the balance to the seller's lawyer. Once the seller's lawyer confirms receipt, they release the keys, and we register you as the new owner electronically via the LINZ e-dealing platform. This typically finishes by 4:00 PM.
A cross-lease title means you own a share of the freehold land under a tenancy-in-common, and lease your specific dwelling from all the co-owners collectively. It is highly regulated. Risks include unconsented structural additions (which violate the flat plan, making the title defective) or disputes over shared spaces. We perform plan audits to make sure the flat plan matches the physical building shape.
If you are utilizing KiwiSaver for your deposit or settlement, you must submit withdrawal applications to your provider at least **15 working days** before the settlement date. Your provider will release the funds directly into our Trust Account. We hold the funds in trust until they are required for settlement.
