Buyer & Seller Guide

How to Choose a Conveyancing Lawyer

Selecting the right legal practitioner is the single most critical decision in your property transaction. The right partner safeguards your deposit, audits title faults early, and provides direct communication when issues arise.

Avoid "Teaser" Quotes

Many cheap online conveyancers advertise unrealistically low base rates (e.g. $800), but add massive hidden administrative surcharges to your final invoice. They charge extra for printing pages, answering phone calls, filing KiwiSaver withdrawals, or storing files.

Our Standard: We provide full, transparent conveyancing estimates detailing professional fees and LINZ disbursements upfront, with no hidden charges.

Key Selection Benchmarks

1. Property Lawyer vs. Conveyancing Practitioner

While both can register property transfers, a property lawyer provides comprehensive asset protection cover. If your property purchase involves a family trust, relationship property agreements (pre-nuptial), or estate drafting, a conveyancer cannot legally advise you. You must hire a registered property lawyer.

2. NZLS Trust Account Regulation

Ensure the law firm you choose is registered with the **New Zealand Law Society** (NZLS). NZLS-regulated firms operate audited trust accounts and contribute to the Solicitors' Fidelity Guarantee Fund. This fund provides statutory compensation to clients in the extremely rare event of trust fund losses, giving you total deposit security.

3. Direct Access & Communication

A property transaction is time-sensitive. If your bank is late releasing funds on settlement day, you must be able to speak directly to the lawyer handling your file. If you are routed through an anonymous call-centre queue or email ticketing system, you risk missing the 4:00 PM settlement deadline, triggering penalty interest.

4. Proactive Vetting Experience

The value of a lawyer lies in what they *find* before you sign. A high-quality property lawyer will identify drainage easements that block extensions, check landslip registers on LIM reports, and verify unconsented modifications, saving you from inheriting massive liabilities.

Shifting Lawyers Mid-Transaction

If you are dissatisfied with your current conveyancer (due to lack of communication or missed deadlines), **you have the legal right to transfer your file to another firm at any stage**.

Solicitor's Lien: Under NZ law, your current lawyer has a lien over your file. They can refuse to transfer your property files to the new firm until you pay their invoice for work completed up to that date. We assist clients in managing this transfer smoothly to prevent settlement delays.

Five Questions to Ask Before Hiring

Prior to instructing a property solicitor, ask them these five critical questions to verify their quality of service:

  • **"Who will personally manage my conveyancing file?"** (Ensure it is a qualified solicitor, not a junior clerk).
  • **"Are there any administrative surcharges for KiwiSaver withdrawals or Home Start grants?"**
  • **"Are all standard LINZ registration disbursements included in your fee quote?"**
  • **"What is your turnaround time for vetting a draft Sale and Purchase Agreement?"**
  • **"How do we handle AML/CFT compliance onboarding?"** (Ensure they offer secure digital biometric verification).

Frequently Asked Questions

Disbursements are external charges that your lawyer pays to third parties on your behalf. These include Land Information NZ (LINZ) registration fees ($90 for transferring ownership, $90 for lodging a mortgage), title search fees ($6), and AML/CFT verification fees. A transparent quote will list these disbursements separately from the lawyer's professional service fee.

While agent recommendations can be helpful, you must ensure your lawyer represents your interests completely. A real estate agent only receives their commission once the contract goes unconditional. Your lawyer's role is to advise you on whether it is safe to go unconditional. Using an independent property lawyer ensures there is no conflict of interest.

If a boundary dispute is discovered (e.g. a fence is in the wrong place, encroaching on the section), a qualified property lawyer will submit a formal objection to the seller's solicitor. We negotiate to have the fence relocated, deduct repair costs from the settlement funds, or cancel the agreement if the issue is severe and cannot be resolved, protecting you from future litigation.
