The Home Buying Process Step-by-Step

Stage 1: Pre-Purchase Planning

Secure a conditional finance pre-approval from your bank or broker. Instruct Quay Law before you start house hunting so we are ready to perform immediate pre-signing contract audits.

Stage 2: Offer & Negotiation

Submit your written offer on an ADLS contract via the real estate agent. Vetting by Quay Law ensures the further terms section contains protective clauses. Accept counter-offers by exchange of initials.

Stage 3: Due Diligence (Conditional)

During the conditional window, we audit the land title. You conduct building inspections and request the council LIM report (Auckland Council standard LIM processing is 10 working days).

Stage 4: Going Unconditional

Once all conditions are satisfied, we send a formal notice to the seller's lawyer confirming the contract is unconditional. You pay the 10% deposit to the real estate agency trust account.

Stage 5: Pre-Settlement Phase

You perform a pre-settlement inspection (checking chattels like heat pumps and stove). We coordinate mortgage drawdowns with your bank and execute the electronic LINZ transfer forms (A&I).

Stage 6: Settlement & Possession

We receive bank loans, combine them with your deposit, and transfer the balance to the seller's trust account. Once confirmed, keys are released (usually by 2:00 PM) and we register your title ownership on LINZ.

The Danger of Settlement Delays & Default Interest

Settlement day deadlines are strict. Under the standard ADLS agreement, if the buyer fails to transfer the settlement funds on the agreed day, they commit a breach of contract.

The consequences are severe: the seller can charge daily **default interest** (typically 12% to 15% per annum on the purchase price) from the scheduled date until settlement occurs. They can also issue a 12-working-day Settlement Notice, allowing them to cancel the contract, forfeit your 10% deposit, and sue for damages.

DEFAULT PENALTY CALCULATION EXAMPLE

If you buy an Auckland property for **$1,200,000** and settlement is delayed due to late finance or KiwiSaver releases, daily penalty interest at **12% p.a.** accumulates as follows:

Daily Penalty = ($1,200,000 x 0.12) ÷ 365 = $394.52 per day
